These Terms of Use govern your use of Haywardpartybuscompany.com and its quote-request features (the “Site”).

When you submit a quote request after being shown a link to these Terms, you agree to them. You must be at least 18 years old and legally able to enter into an agreement. If you do not agree, do not submit a quote request.

1. What This Site Does

The Site is an informational and quote-request website that helps you compare group transportation options.

It provides information about group transportation and lets you submit trip details to compare vehicle options and estimated pricing.

The Site is not a motor carrier or transportation provider. The Site does not:

  • own, lease, operate, maintain, or dispatch vehicles;
  • employ or supervise transportation personnel;
  • perform transportation services;
  • accept transportation payments on this Site; or
  • create, accept, manage, modify, or cancel transportation reservations.

Transportation is provided by companies serving your area.

2. Quote Requests and Pricing

When you submit trip information through the Site, that information is used to show you vehicle options and estimated pricing for your trip.

The company and terms that apply to your trip are identified during the quote process, before you complete anything.

Submitting information through this Site does not, by itself:

  • reserve a vehicle;
  • guarantee that a particular vehicle is available;
  • create a transportation contract;
  • charge a payment method; or
  • require you to complete a booking.

If you later complete a reservation, the terms presented at that time govern the pricing, reservation, payment, deposit, cancellation, refund, vehicle assignment, itinerary, and related transaction.

The company identified in the applicable trip documents is responsible for performing the transportation.

3. General Site Information

The Site aims to provide useful and accurate information. However, general Site content may not apply to every trip and may change over time.

General content—including planning price ranges, vehicle-category descriptions, passenger capacities, photographs, amenities, travel times, venue information, airport information, and local guides—is provided for informational and planning purposes.

Unless expressly stated otherwise:

  • general prices and ranges are not guaranteed quotes;
  • vehicle photographs may be representative examples;
  • amenities vary by vehicle and provider;
  • passenger capacity varies by the actual vehicle configuration;
  • availability may change; and
  • airport, venue, parking, traffic, and loading procedures may change.

Review the actual vehicle information, trip-specific price, availability, itinerary, and applicable terms presented during the quote process before completing a reservation.

4. Transportation Providers

Vehicles and transportation are provided by companies serving your area.

The Site does not control a transportation provider’s:

  • vehicle;
  • route or operating decisions;
  • internal business or staffing decisions;
  • maintenance or inspection practices;
  • pickup or drop-off procedures;
  • delays, substitutions, cancellations, or service performance; or
  • passenger and vehicle policies.

To the fullest extent permitted by law, the Site is not responsible for the acts or omissions of a transportation provider, airport, venue, hotel, or other third party.

Any issue involving transportation performance should be addressed with the transportation provider directly.

Nothing in these Terms excludes responsibility that applicable law does not allow to be excluded.

5. Other Websites and Services

The Site may link or direct users to transportation providers, mapping services, payment processors, airports, venues, or other websites and services.

Those services may have their own terms, privacy policies, prices, and operating practices.

When a website or service is operated by another business, the Site does not control and is not responsible for that business’s content, security, availability, or practices.

The separate terms displayed by any third-party website or service govern its own functions.

A link does not necessarily mean that the Site endorses every statement, product, or service on the linked website.

6. Information You Submit

You agree to provide information that is accurate and complete to the best of your knowledge.

  • submit another person’s contact information without permission;

You remain responsible for reviewing your trip information and correcting any errors before completing a booking.

7. Intellectual Property

The Site’s original text, graphics, design, branding, organization, and software are owned by or authorized for use by haywardpartybuscompany.com and are protected by applicable intellectual-property laws.

You may use the Site for lawful personal or business trip-planning purposes.

Without written permission, you may not:

  • copy and republish substantial portions of the Site;

  • create a misleading copy of the Site;

  • a transportation provider will perform transportation in a particular manner.

To the fullest extent permitted by law, the Site disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

This section does not eliminate warranties or legal responsibilities that cannot lawfully be excluded.

9. Limitation of Liability

To the fullest extent permitted by law, haywardpartybuscompany.com and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

  • use of or inability to use the Site;
  • a quote request;
  • general information appearing on the Site;
  • a linked third-party website;
  • a transportation provider;
  • transportation personnel; or
  • transportation arranged after leaving this Site.

This includes, where permitted by law, lost profits, lost revenue, lost data, lost business opportunities, loss of goodwill, and the cost of substitute transportation.

For a claim arising specifically from this Site or its quote-request functions that cannot lawfully be excluded, the Site’s total liability will not exceed the greater of:

  1. US$100, or
  2. the amount you paid directly for use of this Site during the 12 months before the event giving rise to the claim.

The Site does not charge users to submit a quote request, so the amount paid directly for use of the Site will ordinarily be zero.

These limits do not apply to fraud, intentional misconduct, or any other responsibility that applicable law does not permit the Site to limit.

10. Indemnification for Misuse

To the fullest extent permitted by law, you agree to reimburse and protect the Site from third-party claims, losses, and reasonable legal expenses caused by:

  • your unlawful misuse of the Site;
  • information you knowingly submitted without authorization;
  • your violation of these Terms;
  • your infringement of another person’s rights; or
  • your fraud or intentional misconduct.

This section does not require you to reimburse the Site for losses caused by the Site where the law does not permit that result.

11. Privacy

The Privacy Policy explains how personal information is collected, used, disclosed, and retained.

The Privacy Policy is separate from these Terms. Any Notice at Collection or communication disclosure displayed with the quote form also applies to the information submitted through that form.

These Terms alone do not create consent to receive automated or prerecorded marketing calls or texts.

12. Changes to These Terms

These Terms may be updated as the Site, business practices, or legal requirements change.

The revised version will be posted with a new Effective Date. Updated Terms apply prospectively to use of the Site after the stated Effective Date.

When applicable law requires additional notice or renewed agreement for a material change, that notice or agreement will be provided.
